These Terms of Service ("Terms") govern your use of InsuranceScanner (the "Service") — an insurance comparison and distribution platform for cargo in transit — operated by Talya Global Lojistik Hizmetleri ("we", "us", "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. Accounts must be registered with accurate information and used by the person or organisation named at registration.
2. Accounts and security
You are responsible for safeguarding your password and for any activity that occurs under your account. Notify us at info@talyasmart.com immediately if you suspect unauthorised access.
3. The Service — our role as intermediary
InsuranceScanner is an insurance distribution platform. We collect the details of your cargo and route, obtain indicative premiums from underwriters, brokers and managing general agents, and — where the arrangement with that market allows it — arrange for cover to be placed and a certificate issued.
We are not an insurer. We do not carry risk, we are not a party to your policy, and we do not pay claims. Every policy or certificate obtained through the Service is a contract between you and the insurer named on it, underwritten on that insurer's wording and subject to that insurer's acceptance of the risk.
We do not give advice. Information on the Service — clause comparisons, commodity risk classes, exclusion summaries, premium indications — is factual and general. It is not a personal recommendation that a particular cover, clause level, sum insured or deductible is suitable for you or your cargo. Whether a policy meets your needs, your contractual obligations to a buyer or seller, or the requirements of a letter of credit is your decision. Take independent advice from a licensed broker or adviser if you are unsure.
4. Quotes, binding and certificates
A premium shown on the Service is indicative. It is calculated from the information you enter and is not an offer of insurance. Cover begins only when an insurer accepts the risk and a policy or certificate is issued to you, and only for the period, voyage, transit and sum insured stated on that document.
You are responsible for the accuracy and completeness of what you tell us — cargo description, packing, commercial invoice value, freight and duty, route, conveyance, and any prior loss history. Insurance contracts depend on fair presentation of the risk: a misstatement, an understatement of value, or a failure to disclose something material may allow the insurer to reduce a claim payment, void the policy, or decline the risk outright.
The policy wording prevails. Where anything on the Service — a summary, a comparison table, a clause explainer — conflicts with the certificate, policy schedule or wording issued by the insurer, that insurer's document governs.
5. Premium, our fees and claims
Premium is set by the insurer and is payable for the cover itself. Our platform fees, described on the pricing page, are charged separately for use of the Service and are not premium. Where we or a partner receive a commission from an insurer in connection with cover placed for you, we will tell you so on request.
Claims are decided by the insurer or the adjuster it appoints, applying the policy wording. Filing a claim through the Service is a way to submit and track it — it is not an acceptance of liability by us or by the insurer, and it does not extend any notification deadline in your policy. Notify a loss as soon as you become aware of it, take reasonable steps to minimise it, and preserve the damaged cargo and its packing for survey.
6. Acceptable use
You agree not to:
- Reverse-engineer, scrape or systematically download Service data beyond your subscription quota.
- Resell, sublicense or re-publish Service data without a written commercial agreement.
- Use the Service to arrange cover for cargo or a trade that is unlawful under applicable export-control, sanctions or dual-use regulations, or for a party subject to sanctions.
- Misstate the nature, packing, condition or value of cargo, conceal a material fact or a prior loss, or seek cover for a loss that has already occurred.
- Submit a claim you know to be false, inflated or fraudulent, or supporting documents you know to be altered.
- Probe, scan or test the vulnerability of the Service without written authorisation.
- Use the Service in a way that overloads our infrastructure or degrades it for other users.
7. Platform fees, subscription and cancellation
Use of the Service is charged as described on the pricing page: a per-certificate platform fee with no subscription, or a monthly subscription for shippers declaring shipments under an annual open policy. These fees are for the Service. They are separate from premium, which is set by the insurer and payable for the cover itself.
Subscriptions are billed monthly in advance and renew automatically until cancelled from your billing page. Cancellation stops future renewals and access continues to the end of the paid period; we do not provide pro-rated refunds for partial months except where required by law. Monthly allowances reset on the first day of each calendar month at 00:00 UTC.
Cancelling a subscription does not cancel insurance. Cover already bound continues, and lapses, under the terms of the policy or certificate itself — to cancel cover, or to stop declaring under an open policy, follow the cancellation provisions in that document.
Prices may change. We will give at least 14 days' notice for any increase affecting your subscription, by email and through an in-app banner. We may rate-limit, suspend or withdraw access without notice if we detect abuse, automation, sustained over-allowance use or fraudulent payment activity.
8. Intellectual property
InsuranceScanner, the InsuranceScanner mark, the platform UI, brand assets, code, documentation and the curated databases we maintain (underwriter and broker registry, commodity risk classification, rating tables) are our intellectual property or that of our licensors. Insurer and market names, logos and trademarks shown on the Service remain the property of their respective owners and are used for informational reference only.
9. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted availability. We do not guarantee that the Service will be error-free, that defects will be corrected, or that the underlying carrier data will be complete or current.
10. Limitation of liability
To the maximum extent permitted by applicable law our aggregate liability arising out of or related to the Service will not exceed the greater of (a) the fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim or (b) one hundred US dollars (USD 100). We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profit, cargo, revenue, goodwill or data.
11. Termination
You may cancel your account at any time from the billing page or by emailing us. We may suspend or terminate your account if you breach these Terms, if your payment fails after reasonable notice, or if continuing to serve you would expose us to legal risk. On termination you lose access to paid features; we will keep your account record for the period required by law and then delete it.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or a prominent in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
13. Regulatory status and licensing
Insurance distribution is a regulated activity, and what may lawfully be done differs by country. Cover offered through the Service is arranged by, or in cooperation with, intermediaries and insurers licensed in the territory concerned; where we do not hold the necessary licence ourselves, we introduce you to a partner who does, and that partner deals with you directly on the placement.
Nothing on the Service is an offer of insurance in a jurisdiction where the relevant insurer or intermediary is not authorised to transact. If we cannot lawfully place cover for your route or your entity, we will tell you rather than quote.
14. Governing law and venue
These Terms are governed by the laws of the Republic of Türkiye. Any dispute that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the courts and execution offices of Istanbul (Çağlayan), Türkiye.
